Standardized Operating Procedures
Jortevsky Real Estate Firm does not require prospective homebuyers to show identification, to sign an exclusive broker agreement, or to obtain a mortgage pre-approval before we will show them a home. These are our standardized operating procedures, published as New York Real Property Law § 442-h requires.

Why this page exists
New York Real Property Law § 442-h requires every licensed real estate broker in this state to adopt standardized operating procedures for the prevention of unlawful discriminatory conduct, to publish them on the firm’s website, and to file them with the New York Department of State.
The point of the law is simple: a requirement that is applied to some prospective buyers and not others is how discrimination usually happens in practice. Publishing the procedure in advance means every buyer knows what is asked of them before they walk through a door, and can tell when they are being treated differently.
The three required answers
Do we require prospective homebuyers to show identification?
No
We do not require prospective homebuyers to show identification before we will speak with them, answer questions about a property, or show them a home. Identification may be requested later in a transaction where a seller, a building, a lender or a closing agent requires it — and where it is requested, it is requested of every buyer in the same circumstances.
Do we require an exclusive broker agreement?
No
We do not require prospective homebuyers to sign an exclusive buyer-representation agreement before we will show them a property. We will explain the agency relationship options available to you, including exclusive representation and what it does and does not commit you to, and the choice is yours.
Do we require a pre-approval for a mortgage loan?
No
We do not require prospective homebuyers to obtain a mortgage pre-approval before we will show them a property. We will tell you plainly that a pre-approval strengthens an offer in this market, and a seller may require proof of funds or financing before accepting one — but that is the seller's condition on an offer, not ours on a showing.
How we work with every prospective buyer
- We show homes to prospective buyers without regard to race, creed, color, national origin, sexual orientation, gender identity or expression, military status, sex, age, disability, marital status, lawful source of income, familial status, citizenship or immigration status, or any other class protected by federal, New York State or New York City law.
- Lawful source of income includes housing vouchers, Section 8, HASA, SSI, Social Security, child support, alimony and any other lawful subsidy. Refusing to rent or sell to someone because of it is unlawful in New York.
- We do not steer buyers toward or away from neighborhoods on the basis of any protected class, and we do not answer questions about the racial, religious or ethnic composition of an area. We will give you data — schools, taxes, transit, flood designation, sales history — and you decide what it means for you.
- Where a seller, a co-op or condo board, a building, a lender or a closing agent imposes a requirement on a buyer, we apply it to every buyer in the same circumstances, and we will tell you whose requirement it is.
